The New York Times reports that an artist "is suing Trinity Church in Lower Manhattan for moving his bronze re-creation of a huge sycamore tree that once stood in the churchyard." According to the Times, his claim (or one of his claims) is that VARA "prohibits the removal of sculptures created to be installed permanently at a particular site." Those types of claims under VARA have not fared well in the past.
